SMS Terms and Conditions
These terms govern the Elyptis AI Missed Call Auto-Response SMS program operated by Jacobe Delcastillo, a sole proprietorship based in Port St. Lucie, Florida ("Elyptis," "we," or "us"). By placing a phone call to a business that subscribes to Elyptis and replying YES to the resulting transactional SMS, you agree to these terms.

Elyptis AI Missed Call Auto-Response.
Program description
When you place a phone call to a small business that uses Elyptis and the call is not answered, Elyptis sends you a single automated text message on the business's behalf within about 60 seconds. The message identifies itself as an AI assistant, acknowledges your missed call, and lets you know the business will return your call. A short series of follow-up messages may be exchanged to gather basic qualifying details (your name, reason for calling, callback preference) so the business can respond effectively. All messages are strictly transactional and sent only in direct response to a customer-initiated phone call. We do not send marketing, promotional, or cold outreach content.
How you consent — two-step opt-in
Step 1 — Point-of-call disclosure. The phone number you dialed is publicly listed by a business that subscribes to Elyptis with a clear AI-assist disclosure (see our consent flow walkthrough for the standard disclosure copy and a sample listing). Subscribing businesses are contractually required to display the disclosure on their Google Business Profile, contact section of their website, and any signage where the number appears.
Step 2 — SMS keyword confirmation. When your call goes unanswered, Elyptis sends one transactional SMS that identifies the brand as Elyptis AI, names the originating business, and asks you to Reply YES (or Y, START) to schedule a callback. No follow-up messages are sent unless you reply with one of those keywords. Once opted in, the conversation is capped at 5 total messages and is scoped strictly to scheduling the callback. The conversation does not roll into any subscription, list, or recurring campaign.
Under the Telephone Consumer Protection Act (TCPA) 47 U.S.C. § 227(b)(1)(A)(iii), the call you placed to a publicly-disclosed business number provides the legal basis for the initial transactional reply; the SMS keyword confirmation provides the explicit opt-in for the follow-up scheduling conversation.
Message frequency
Message frequency varies based on your conversation. Typically you will receive 1–5 messages per missed-call incident. We do not send recurring marketing messages or ongoing campaigns.

Opt-in keywords
To confirm enrollment after the initial transactional reply, reply YES, Y, or START. You will receive an opt-in confirmation message identifying Elyptis AI Missed-Call Service and confirming the 5-message cap.
Opt-out instructions
You can opt out of the Elyptis SMS program at any time.
- Reply STOP to any message to end the conversation immediately. You may also use STOPALL, UNSUBSCRIBE, CANCEL, END, QUIT, REVOKE, or OPTOUT.
- After you reply STOP, you will receive a single confirmation message, and no further texts will be sent from that number.
- To resume messages after opting out, reply START.
Help instructions
For help at any time, reply HELP or INFO to any message from the program. You will receive a response that identifies the service, provides support contact information, and repeats the STOP opt-out instruction. You can also contact support directly using the information below.
Quiet hours
We do not send messages between 9:00 PM and 8:00 AM local time, in line with CTIA and carrier best practices.
Supported carriers
The Elyptis SMS program works with all major U.S. wireless carriers, including AT&T, Verizon, T-Mobile, and their prepaid and MVNO brands. Carriers are not liable for delayed or undelivered messages.
Eligibility
This program is intended for individuals 13 years of age or older, located in the United States. You must be the subscriber or authorized user of the phone number you use to place the original call.
Privacy
Information you share through SMS is handled in accordance with our Privacy Policy. We share your conversation content only with the business you contacted. We do not sell your information and do not use it to train AI models.
Changes to these terms
We may update these terms from time to time. If we make material changes, we will update the "Last updated" date at the top of this page. Continued participation in the program after changes means you accept the revised terms.
